1. OVERVIEW

This website is operated by Mr.D Wine Merchant LLC. Throughout the site, the terms "we," "us," and "our" refer to Mr.D Wine Merchant LLC. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including any additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms carefully before accessing or using our website. If you do not agree to all the terms and conditions herein, you may not access the website or use any services. Any new features or tools added to the store will also be subject to these Terms.

Our store is hosted on Shopify Inc., which provides the e-commerce platform enabling us to sell our products and services to you.

2. ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction.

3. SHIPPING & DELIVERY

Title to, and ownership of, all alcoholic beverages passes from a Licensee to the purchaser at the licensed retail premises or warehouse and state it is purchased in and the purchaser takes all responsibility for shipping it from the licensed retail premises or warehouse to his/her home state. By arranging for transportation of the alcoholic beverages, the retailer is providing a service to and acting on behalf of the purchaser. By utilizing this service, the purchaser is representing that he/she is acting in a fashion compliant with his/her local and state laws regarding the purchase, transportation, and delivery of alcoholic beverages. The purchaser represents that he/she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of alcoholic beverages, and is legally entitled to take quantities ordered and once again authorizes that he/she is 21 years of age.

Local Delivery
We offer local delivery for a flat fee of $15 within a 15-mile radius of our location (3020 NW 7th Ave, Miami, FL 33127).

Shipping Rates
Shipping rates are calculated based on several factors, including distance, weight, and the shipping service selected. You can view the final shipping cost at checkout.

Fulfillment Timeline
Orders are typically fulfilled within 2–10 business days. This timeline refers to order processing and excludes the transit time of the shipping service selected.

Delivery Restrictions

We do not deliver to P.O. Boxes.
All orders require an adult signature upon delivery.

Weather & Shipping Risks
By selecting a delivery service, you acknowledge that Mr.D is not liable for damage to wine resulting from adverse weather conditions (including heat or cold) or delayed delivery once the package is in transit.

Loss & Damage
Once a package is handed off to the shipping carrier, responsibility for the shipment transfers to the carrier. Mr.D is not liable for loss, theft, or damage occurring during transit. However, if your order arrives damaged or does not arrive at all, please contact us within 48 hours of the expected delivery date so we can assist you in filing a claim with the carrier.

4. VINTAGE SUBSTITUTION POLICY

For wines priced at $20 or below, if the selected vintage is no longer available at the time of order fulfillment, we reserve the right to substitute a comparable vintage of the same wine without prior notice. For wines priced above $20, we will contact you for approval prior to substituting the vintage. If we do not receive a response within 60 days, the order will be held until confirmed or deemed abandoned per our Unconfirmed Vintage Changes & Order Abandonment policy.

5. UNCONFIRMED VINTAGE CHANGES & ORDER ABANDONMENT

In the event of a vintage change for wines priced over $20, we will notify customers to confirm acceptance of the new vintage. If we do not receive a response within 60 days of our first outreach, and we remain in possession of the wine, the order will be considered dormant.
Orders that remain unconfirmed for more than 12 months from the original purchase date may be deemed abandoned. In such cases, Mr.D Wine Merchant LLC reserves the right to cancel the order without refund, credit, or replacement. This policy is enforced to the extent permitted by applicable law.

6. CANCELLATION

Once an order is placed and payment processed, cancellations may incur a 10% fee. If the order has already shipped, return shipping and restocking fees will also apply.

7. RETURNS

If an order is returned or declined after delivery, or returned due to failed delivery attempts (e.g., no adult signature), the purchase will be refunded minus original shipping, return shipping, and a 10% restocking fee. Returns must be initiated within 5 days of delivery; no returns or refunds will be accepted beyond that window.

8. CORKED OR FAULTY WINES

Cork taint (TCA) and other wine faults are rare but possible, especially with natural cork closures. If you believe a wine is corked or otherwise faulty, please contact us within 7 days of opening the bottle. We may request that the bottle be returned (with most of the contents intact) for inspection. At our discretion, and in collaboration with the producer or distributor, we may offer a replacement, store credit, or refund.

Please note that we cannot guarantee refunds or replacements for wines aged beyond 10 years, or those affected by improper storage after delivery.

9. PRODUCT INFORMATION & PRICING

Prices and product descriptions are subject to change without notice. We reserve the right to discontinue or limit the quantities of any product. Product images and vintages may vary from those shown.

10. ACCURACY OF BILLING & ACCOUNT INFORMATION

You agree to provide complete, up-to-date information. We may cancel or limit orders based on our discretion and will attempt to notify you via the contact information provided.

11. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools and links. Use of these tools is at your own risk, and we are not liable for any third-party content or services.

12. USER CONTENT & FEEDBACK

Any feedback, comments, or submissions you provide may be used by us without restriction. You are responsible for the legality and accuracy of your content.

13. PERSONAL INFORMATION

These Terms shall be governed by and construed in accordance with the laws of the State of Florida.
